We are disappointed that Judge Tuchi lifted the TRO, because the fact that the USFS is shipping Arizona wild horses to killpens in Texas is unconsionable.

The judge did not agree that the impoundment notice is too broad, but he did not have a good understanding that it spans millions of acres over 3 different ranger districts.

However, we will take the little win that he at least found that the Plaintiffs (us) raised serious questions about the deficiencies of the United States Forest Service’s Notice of Sale, which can be further litigated along with our amended claims of the contractor’s outrageous self dealing and shill bidding.

It stated in the order that the defendents USFS, acknowledged in their reply that they will be required to issue another Notice of Sale before the 13 horses may be sold with 5 days notice. We think the judge should have at the very least warned USFS to do it right this time and every time in the future, but he is relying on their own acknowledgment, so we will see where and when the notices will be posted.

The road to justice is long for wild horses + for the public who loves them. But that’s never stopped us before and never will.
